Welcome to Alertro Alerting System

Alertro (together with its subsidiaries and affiliates, “Alertro,” “We,” “Us,” and “Our”), is committed to respecting your privacy. This privacy policy (“Privacy Policy”) describes how We collect, process, and share your Personal Information, and the rights and choices that are available to you with respect to your Personal Information.

By using our app SMART Community Alerting System (CWS) (the “App”), you acknowledge that you have reviewed both our Terms and Conditions [www.alertro.net/terms-of-service] and this Privacy Policy and agree to be bound by them. Please be aware that this Privacy Policy does not apply to the practices of any third parties to whom We may disclose Personal Information (as defined below) pursuant to the terms of this Privacy Policy.

This Privacy Policy may apply to any user and/or Administrator that uses the App or Our Services in any way or form (“User” or “You“).

This Privacy Policy may be occasionally updated. If We make any substantial changes in the manner We use your Personal Information, then We will provide a proper notice.

Applicability of this Privacy Policy to Our Services 

This Privacy Policy applies to the Personal Information that Alertro processes in its role as data controller –in circumstances where Alertro determines the purposes and means of the processing of your Personal Information. This includes the Personal Information We collect when you interact with Us in certain contexts online, or when you communicate with Us via email, and/or text message,. It also includes the Personal Information We collect when you interact with Us in certain contexts offline, for example, when you see Us at conferences or trade shows, or when you communicate with our sales or support service teams in person, via phone, or by postal mail. In some circumstances this Privacy Policy applies to the Personal Information that Alertro processes in its role as data processor for example, when You access or use Our App, certain Alertro’ services which are intended to be managed and administered by an Administrator, and which are  intended to assist an Administrator and Authorized Users (as defined in Our Terms and Conditions) appointed by Administrator, to promptly alert and inform Users of certain events or alerts (the “Services”).

In case the business client is the data controller, and We are the data processor which process your Personal Information in accordance with the agreement We have with that business client, We encourage You to review the privacy policies of such business client as well as this Privacy Policy, so that you understand how your Personal Information is collected, used, and shared. We are not responsible for the privacy policies or other content in case the business clients are the data controller. Whether We act as a data controller or as a data processor depends on the nature of the activities and our agreement with our business client. If you have questions about Alertro’s processing of your Personal Information in your capacity as an Alertro client’s employee, member or customer, please contact that client directly.

  1. Personal Information We Process

“Personal Information” – any information that We may collect from You and that You share with Us on the App in respect of yourself and/or others, that may be used to identify any individual.

The Personal Information We process may include:

  • Device Information: When You access or use our App, or open our emails, We may learn information about your browser or device (e.g., name or type, version, settings, etc.), IP address, unique online identifiers (e.g., MAC address, mobile device identifiers, etc.), internet service provider or mobile network information, precise geolocation data and the date and time of your visit.
  • Usage Data: We process information about your interactions with Our Services, inter alia, through Our App, and emails, how often and for how long you use the App, links, performance data, and other similar interactions with Our App, emails.
  • Non-Precise Location Data: When You access or use our App, or open our emails, We may learn your non-precise geographic location, including by collecting your IP address or other device information. Please note that, in connection with certain Services, and where you have expressly enabled a relevant feature within your mobile device’s settings, We may process precise geolocation data.
  • Contact Information: We may process your contact information, including identifiers such as your first and last name, , telephone number, and email address.
  • Demographic Information: We may process demographic details about you such as your birthdate or age, gender, community membership, educational institutions of family members, and similar demographic details.
  • Call Records, Email Records: If you call, text, email, submit questions or comments via our App to contact Our support service representatives (or other agents or representatives of Alertro), or reach out to Us via any social media platform, or contact Us via other forms of inbound communication, We may keep records of those conversations including any information you have provided to Us in connection with such conversation.
  • Submitted Content: We process any Personal Information you submit to Us via the App, email, or postal mail, including any Personal Information contained in your written feedback, product reviews and testimonials, responses to surveys, or other information, photos, or videos. “Submitted Content” also includes Personal Information that You share with Us through your mobile device’s settings, such as when you allow Our App to access photos, files, or documents on your device, or create audio, pictures or video recordings (e.g., when you use Our App to record what is happening around You when you feel unsafe).
  • Account Credentials: If you register an account with Alertro, We process your account credentials, including your account log-in name and password.
  • Inferences: We may draw inferences about any of the information in this Section 1 that may relate to your preferences, characteristics, or other matters.
  • Sensitive Data: Our Services may require Us to process Personal Information that may be considered “sensitive data,” or “special category” data, as those terms (or similar terms) are defined under applicable data protection laws, including:
    • precise geolocation data which may be supplemented by “motion data” collected from your mobile device (our use of “motion data” improves our ability to determine your precise geolocation while using less of your device’s battery).
  • Children’s Data: If you are a user of Our Services, We may process information that you provide Us with, about your children, including your children’s educational institute names and its locations, ages and descriptions. We may also process information, that you provide Us with, about your children that may constitute “Sensitive Data” as set out above.

Alertro may anonymize or aggregate certain of the above categories of information so that it is no longer linked or reasonably linkable to you, at which time it is no longer “Personal Information”. We will not reidentify or attempt to reidentify such information unless We are required by law to do so.

  1. How We Collect Your Personal Information

We may collect the information described above from various sources, including directly from you, from an Alertro’ business client with which You have a relationship, from third parties We partner with, and through cookies or other automated means.

  • Directly from You: We collect information directly from You when You provide it to Us, including when you contact us through Our App, via email, phone, text message, postal mail, on any social media pages, , or communicate with Our employees and agents in person; upload Submitted Content to Our App or submit it via email, postal mail, or social media); create an Alertro account; respond to a survey or questionnaire or provide a testimonial; or select or update your communication preferences.
  • Automatically from Your Device or Browser: Certain information (e.g., Device Information, Usage Data, Non-Precise Location Data, and (if you choose to enable Precise Location Data) is automatically collected from your device when You use Our App.
  • From Third Parties: Certain third parties may share information with Us that they have collected from or about You, including, for example, data analytics companies, business partners, or service providers and vendors that assist with the operation and functionality of App and Our business more generally.
    If You are a User of Our Service as a result of your relationship with a particular Alertro business client , We may receive information about You from such business client, and likewise, if You are a family member of an individual who has a relationship with a particular Alertro’ business client, then We may collect information about You from your family member or the relevant business client.
  1. How We Use Your Personal Information

How We use the Personal Information We collect depends on how You interact with Us and may include the business or commercial purposes listed below. Where We refer to the legal bases for processing your Personal Information, such bases apply only to the extent applicable data protection law requires us to have a lawful basis for such processing.

  • Performance of Our Services: We and Our service providers will process your Personal Information for the purposes of performing Our Services, including:
  • ; provide you with the system functionality (Reporting of events, alerts, notifications etc)
  • when you create an Alertro account, register as a user (as a User, Member, Administrator or Authorized User) of Our App or Services;
  • to assess and troubleshoot issues that arise in connection with the use of the App and other Services; and
  • If You have a relationship with a particular Alertro’ business client, or You are a family member of such an individual, We will process your Personal Information as required by Our contract with that business client.

We rely on several legal bases for the processing of your Personal Information for the purpose of providing Our Services, as follows:

    • Performance of a contract: When processing account credentials; Contact Information; Demographic Information;; Travel-Related Data; Sensitive Data; and Children’s Data.
    • Consent: When processing Device Information, Usage Data and Non-Precise Location Data collected via non-essential cookies (where such consent is required by applicable law); and, in certain circumstances, when processing Sensitive Data.
    • Vital interests: Where it is in your or another person’s vital interests to process the Personal Information We maintain in connection with Our Services or App.
    • Legal obligation: Where We are required to process Personal Information in order to meet Our legal obligations.
    • Alertro’s legitimate interests: When processing Submitted Content; when drawing Inferences from the Personal Information you provide.
    • Where required by law We will process “special category” data only with your explicit consent.

We rely on the following legal bases for the processing of your Personal Information for advertising and marketing purposes:

    • Alertro’s legitimate interests: Where permitted by applicable law, We may process your Personal Information in order to contact You for Our marketing and advertising purposes because it is in Our legitimate interests to promote Our Services, We think you might be interested in.
    • Consent: Where required by applicable law, We will process your Personal Information in order to contact You for Our marketing and advertising purposes only after You have consented to receive Our marketing communications. With your consent, We may also include your name alongside any testimonial You provide.

You can opt-out of (or withdraw your consent to) receiving Our marketing communications or ask us to remove your testimonial from the Services or Our marketing materials, at any time.

  • Maintaining & Improving Our Services: We may process your Personal Information in order to analyze your use of Our Services and Our Services’ performance. For example, in order to maintain and improve the App and Services and to develop new features or services or to create AI-based functions. We may, from time to time, aggregate your information and information of other users to help us analyze trends and purchasing patterns, preferences, etc.

We rely on Alertro’s legitimate interests as the legal basis for the processing of Personal Information for purposes of understanding our business clients and users; maintaining, changing, and improving our Services; and developing new features and services.

  • Security and Fraud Prevention: We will process your Personal Information as needed to protect Alertro, Our employees, Our business clients and partners, and Our Users from fraud, security threats, and other illegal or harmful activity.

We rely on Alertro’s legitimate interests and legal obligations as the legal bases for processing your Personal Information for security and fraud-prevention purposes.

  • Legal Obligations: We will process your Personal Information as needed to comply with legal and regulatory requirements and to respond to requests from courts or other governmental or regulatory authorities.
  1. How We Share Personal Information with Third Parties

We may share information with third parties for certain business or commercial purposes. For example:

  • Service Providers and Business Partners: We partner with third-party service providers and business partners to assist with many aspects of Our business, including, analyzing Our users’ interests and activities, distributing and processing surveys, providing telecommunication services, providing certain functionalities on Our App and Services, helping Us communicate with Our business clients and Users, and operating Our business more generally.
  • Business Clients: If You have a relationship with a particular Alertro’ business client, or You are a family member of such an individual, We may share your Personal Information as required by Our contract with that business client.
  • Affiliates or Successors: We may disclose certain Personal Information to Our affiliates and subsidiaries for their use. Your Personal Information may also be transferred to another entity that succeeds, or intends to succeed, to all or part of Our business in connection with a sale, reorganization, consolidation, or merger.
  • Other Third Parties: We will disclose information about You to third parties, including to government bodies or law enforcement agencies, when We believe it to be necessary for compliance with the law or to protect Alertro, Our clients and Users, Our employees, or the public more generally, including inter alia, in case We reasonably believe it is necessary to: (i) investigate any suspected fraud or misuse of the App or Services; (ii) protect or defend the rights, property, or interests of Alertro, Our employees, Our clients and users, or the rights, property, or interests of Our business partners or service providers; or (iii) protect the personal safety of Our employees, clients and any Users.
  • At Your Direction, or to Protect Your Vital Interests: We will disclose information about You to other third parties at your direction or with your consent, or as needed to protect your, or another person’s, vital interests. For example, certain of Our Services may include the sharing of your name and contact information with emergency services (911, police, emergency respondents), medical facilities. Unless in an emergency (for example where We need to provide information immediately to the police), when We rely on vital interests as the legal basis for such sharing, We will act on your instructions or ask for your consent before sharing your information.
  1. Your Privacy Rights and Choices

If You are a resident of the EU/EEA or any other relevant country, You may at any time request the rectification or erasure of your Personal Information. You have the right to request a copy of your Personal Information from Our record, You have the right to request a limitation of the use of your Personal Information (for example if You deem the information to be incorrect) or the termination of use of your Personal Information Please note however that deletion could mean that Alertro cannot provide You any requested Services. If You wish to do so or You have any questions or queries about this Privacy Policy or Our services in general, please do not hesitate to contact Us at: privacy@alertro.net and clearly stating the request(s) you’d like to make.

Authorized Agent. You may also choose to authorize an agent to make the above requests or exercise your rights. If You use an agent, We will take measures to verify your agent’s authorization to act on your behalf and We may require more information to ensure proper verification of both you and your agent’s identity and authorization.

Please note that Alertro may not be able to respond to your request if We cannot verify your identity, or your agent’s identity and authority to make the request, and confirm the Personal Information relates to you.

Appeals. You may appeal Our decision to decline your request by emailing Us at privacy@alertro.net, and clearly stating the decision(s) You wish to appeal. If You are dissatisfied with Our decision on appeal, and You live in the U.S., You may contact the regulatory authority. You can use the website located here to help you find your state’s attorney general’s contact information.

  1. Children

We do not knowingly or purposefully request or collect Personal Information from children, except as required to provide Our Services to such child’s parent or guardian, or to the employer of such child’s parent or guardian. If You believe that such Personal Information was provided to Alertro without applicable consent, please contact us at privacy@alertro.net.

  1. Security

The security of your Personal Information and Our business clients’ information is important to Us. We have implemented appropriate safeguards designed to reasonably secure your Personal Information from accidental loss and from unauthorized access, use, alteration, and disclosure. Unfortunately, We cannot guarantee the security of information provided over the internet or stored in Our databases. Your transmissions are, therefore, at your own risk. We urge you to take every precaution to protect your Personal Information when You use Our App.

  1. Retention

We retain Personal Information for so long as reasonably necessary for the purpose for which it was collected (for example, to provide you with Services you have requested), unless We are required by law to dispose of it earlier or to keep it longer. We also retain Personal Information as necessary to comply with Our legal obligations, resolve disputes, pursue legitimate business interests, conduct audits, and protect or enforce Our rights.

  1. International Data Transfers

Personal Information may be processed by staff who work for Us or for one of our service providers or partners in a country different from the country where the data was collected. We will only transfer your Personal Information as permitted by applicable law. Certain data protection laws require data controllers to put in place safeguards to protect Personal Information transferred across borders.

  1. Links to Other Platforms

Our App may, from time to time, contain links to websites owned and operated by third parties (“Third- Party Platforms”). We encourage You to review the privacy policies of such Third-Party Platforms so that you understand how those websites collect, use, and share your Personal Information. We are not responsible for the privacy policies or other content on Third-Party Platforms.

If you engage or communicate with Alertro on a social media platform (e.g., LinkedIn, Facebook, etc.), We may contact You via direct message or use other social media tools to interact with You. In these instances, your communications and interactions with Us are governed by this Privacy Policy as well as the Privacy Policy of the social media platform You use.

  1. California Privacy Rights

This section contains additional disclosures required by the California Consumer Privacy Act (as amended by the California Privacy Rights Act, and as may be further amended from time to time, and together with all implementing regulations, the “CCPA”).

Right to Access Personal Information Collected, Disclosed or Sold:

You have the right to ask Us to disclose to You certain information regarding Our collection and use of your Personal Information over the past 12 months. Once We receive and confirm your verifiable consumer request (as described below), We will disclose to you:

  • The categories of personal information We sold about you;
  • The categories of personal information We disclosed about you;
  • The categories of sources for the personal information We collected about you;
  • Our business or commercial purpose for collecting or selling that personal information;
  • The categories of third parties with whom We shared that personal information;
  • The specific pieces of personal information We collected about you; and/or
  • If We sold or disclosed your personal information for a “business or commercial purpose”, as defined in the CCPA, lists of sales, identifying the categories of personal information that each category of recipient purchased or obtained.

Right to Request Deletion of Personal Information

You have the right to request that We delete any of your Personal Information that We collected from you, subject to certain exceptions. Once We receive and confirm your verifiable consumer request, We will delete, and direct Our service providers to delete, your Personal Information from Our records, unless an exception applies.

We may deny your request to delete your Personal Information if retaining the information is necessary for Us or Our service providers to:

  1. Detect security incidents, protect against malicious, deceptive, fraudulent, or illegal activity; or prosecute those responsible for that activity;
  2. Debug or identify and repair errors that impair existing intended functionality;
  3. Exercise free speech, ensure the right of another consumer to exercise that consumer’s right of free speech, or exercise another right provided for by law;
  4. Comply with the California Electronic Communications Privacy Act;
  5. Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when Our deletion of the information is likely to render impossible or seriously impair the achievement of such research, if you have provided informed consent;
  6. Enable solely internal uses that are reasonably aligned with your expectations based on your relationship with Us;
  7. Comply with a legal obligation; and/or
  8. Make other internal and lawful uses of the Personal Information that are compatible with the context in which you provided such information.

Right to Non-Discrimination

We will not discriminate against you for exercising any of your rights under the CCPA. Unless permitted by the CCPA, We will not:

  1. Deny you goods or services;
  2. Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties;
  3. Provide you a different level or quality of goods or services; or
  4. Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

Right to Opt-out of the Sale of Personal Information

You have the right to opt-out of the sale of Personal Information We have collected about you.

Within the past 12 months, We have disclosed to the following third parties your personal information:

  1. Affiliates;
  2. Service providers; and/or
  3. Third parties to which you authorized Us to disclose personal information in connection with products or services provided to you.

California Shine the Light Law

California Civil Code Section 1798.83 permits Our visitors who are California residents to request certain information regarding Our disclosure of Personal Information to third parties for their direct marketing purposes.
